Malpractice & Maladministration Procedures

Introduction

A-Security Solutions Ltd is responsible for preventing, identifying, and investigating all instances of suspected or alleged malpractice and maladministration. Appropriate action will be taken where necessary to protect the integrity of assessments, qualifications, and the reputation of awarding organisations.

Definitions

Malpractice

Malpractice refers to any deliberate action, neglect, default, or improper practice that compromises:

  • The integrity of the assessment process
  • The validity of results or certificates
  • The integrity of regulated qualifications
  • The reputation and credibility of the awarding organisation
  • The wider qualifications community

Maladministration

Maladministration refers to any activity, neglect, or practice that results in failure to comply with the required procedures for delivering qualifications and assessments.

Reporting and Investigation

Where malpractice or maladministration is suspected whether involving learners, staff, or other parties A-Security Solutions Ltd will:

  • Report immediately to the relevant awarding organisation (particularly where learners have already been registered)
  • Conduct a thorough investigation, documenting:
    • The nature of the incident
    • Individuals involved
    • Evidence gathered
    • Actions taken
  • Maintain records for submission to the awarding organisation and regulatory authorities (e.g. Ofqual) upon request

Learner Misconduct Procedure

Where learner misconduct is identified or reported, the following actions will apply:

  • The invigilator or Centre Contact has the authority to remove (expel) a learner from the assessment room if necessary
  • Any disruption during an assessment will be recorded and time-stamped
  • Where appropriate:
    • The assessment may be paused
    • Lost time for other learners may be reinstated
    • In cases of serious disruption, the assessment may be cancelled and rescheduled
  • The removed learner’s assessment materials will be securely retained
  • A formal report will be completed and submitted to the Centre Contact
  • Documentation will be made available to the awarding organisation and Ofqual upon request

Examples of Learner Misconduct

Learner misconduct includes, but is not limited to:

  • Failure to comply with assessment rules and instructions
  • Disruptive behaviour during assessments (e.g. talking)
  • Use of unauthorised devices such as mobile phones or electronic equipment, including:
    • Searching for answers online
    • Contacting others for assistance
    • Accessing stored information during the assessment
  • Plagiarism or copying another learner’s work in practical, theoretical, or portfolio assessments
    • Both parties may be held responsible where there is shared intent

Centre Malpractice & Maladministration Procedure

Where malpractice or maladministration involves centre staff or processes, A-Security Solutions Ltd will:

  • Report the issue to the Lead Quality Assurer (LQA) of the relevant awarding organisation
  • Conduct a full investigation into the allegation or complaint
  • Gather and review all relevant evidence
  • Cooperate fully with awarding organisations and regulatory authorities
  • Implement corrective actions to prevent recurrence
  • Maintain detailed records of findings and actions taken

Outcomes and Actions

Following investigation, actions may include:

  • Disqualification of learners
  • Withholding or revocation of results/certificates
  • Disciplinary action against staff
  • Notification to awarding organisations and regulatory bodies
  • Review and improvement of internal processes
